Open Public Hearing Regarding Application for Alcoholic Beverage License for The Reserve at Woodland.

Commissioner Gulmon asked about indicating “yes with special event permits” on question 1 under the License application Questionnaire as he thought this license was just for this specific event center.

Kayla Cash with The Reserve at Woodlands stated they do this at their other venues.  If there is an event and someone needs a licensed server at a different location, they would get a special event permit in those cases.

City Attorney Martineck stated allowing this was in the original plan as long as they applied for the special event permit each time.

City Attorney Martineck stated the PZ Commission reviewed this issue and determined the 25% lot depth was no longer applicable and changed it to a straight 25 feet.

City Attorney Martineck stated these changes are to bring our code more in-line with the international maintenance code and clarification on enforcement and an appeal process.

Viking Court Update Due Nov 15^th.

City Administrator Crawford stated there is work being done but it is taking a while. We need some sort of guarantee, so we will continue to work with David the next couple of weeks and before we approve his renewal, we will need documentation signed as to when work will be completed by December 6^th.

City Administrator’s Report

City Administrator Crawford reported the 6-10-year plan is being reviewed and adjusted. We will be bidding our cleaning for all our buildings. We are also looking at fuel prices and what options we have. Complaint calls for snow removal are extremely high at already, people are calling on their neighbors too so the PD is extremely busy taking those calls. Talk to your neighbor, be neighborly, work together, this is only the first snow occurrence of the year.

City Updates & Commission Reports

Finance Director Richter reported the county conducted their tax deed property sale this morning.  There was one property in the city that did not have any bids so we have taken that over as there were specials applied to it.

Fire Chief Magnuson stated the annual fireman’s dance is on Friday after Thanksgiving. Keep your pets away from the river. We will hit over 100 rescue calls this year which is unheard of so thank you to our volunteers.

Police Chief Hatcher reported the PD is fully staffed again.  Consider where you are moving your snow. Do not put snow on other people’s property and it may be there for awhile so try to avoid visual obstructions if possible.  

Commissioner Bishop thanks the FD and PD for the job they do.  It seems the whistle has been going non-stop. Also, to the city crew for all the work they do at all different hours.

Commissioner Magnuson asked that people try to be aware when the whistle does blow, where the emergency vehicles and volunteers are and to move over to clear the path. Also, if you are planning a remodel or new build and come to get a building permit or something related, ask if there are any programs available to help you with your projects.

Mayor Carlsrud thanked everyone for all the work they do. Some people ask why we don’t send the crews out to clean the streets right away or when there’s 1-2 inches of snow on them. We some numbers together a couple years when we had a storm and there was about 5-8 inches and it cost right around $20,000 to clear that.  We try to make good decisions and the best use of your tax dollars.

City Administrator’s Report

City Administrator Crawford stated we had an update with David Wick regarding the Viking Trailer Court.  He will provide another update on the November 15^th meeting.

We were awarded the Urban Grant Program.  We will review that to see if it works for what we need and if so, we will accept it.

City Updates & Commission Reports

Fire Chief Magnuson informed everyone that they were going to hold the traditional fire truck being pushed into the fire station ceremony to put the new truck into service.

Commissioner Gulmon stated over $2 million in flood expenses has been sent into the state to review. Cash reserves remain strong and a decision was made to bid out about $3.3 million of our cash reserves to CDs to earn higher interest. Sales tax is down through August about 3.5% from a year ago, Food and Beverage is up about 7.7% and Occupancy Tax is up about 12%.

Mayor Carlsrud reminded everyone to have your garbage out by 7 AM.

Approve First Reading of Ordinance 1115, an Ordinance to Amend and Reenact Section 7-05-04 of the Valley City Municipal Code Related to Obstruction in a Public Right of Way.

City Attorney Martineck stated we have an ordinance that says citizens can’t place obstructions in the right of way.  This will give the city the ability to remove the obstruction, if the owner cannot be contacted, and store it for 30 days. After the 30 days, if the owner has still not been reached, the city can dispose of the property.

Approve First Reading of Ordinance 1120, an Ordinance to Create and Enact Section 7-01-06.1 and Amend and Reenact Section 7-01-07 of the Valley City Municipal Code Related to the International Property Maintenance Code and Unsafe Buildings.

City Attorney Martineck stated this ordinance is to adopt the most current definitions of dangerous building and adopt the International Property Maintenance Code which appears to be the standard for enforcing property maintenance issues.

Approve Resolution 2375, a Resolution Amending the Master Fee Schedule.

City Attorney Martineck stated this is to include the fees for fire extinguisher services.

Public Works Manager Jacobson requested an increase in rates by 5% for all consumption rates, leaving base rates as is.  This is due to our rates increasing.

Approve Resolution 2377, a Resolution Establishing Rates and Fees for Solid Waste Service.

Public Works Manager Jacobson requested an increase in residential rates from $14 to $15/month and commercial from $24 to $26/month and dumpster collection fees $3 for each 2 yards. This is due to our rates increasing.

Approve Resolution 2378, a Resolution Establishing Fees for Water Service.

Public Works Manager Jacobson requested an increase in rates by about 10% for all consumption rates, leaving base rates as is.  This is due to our rates increasing, mainly our water treatment chemicals.

City Administrator’s Report

City Administrator Crawford stated we need consensus on what to do.  There is a project on I94 business loop near 3^rd Street SW that bids were put out.  Border States had the low bid but we received the concurrence of award request from the State since all bids were 35% over.  They would like a concurrence tonight but we would like to do some more research before we make that decision.  Commission approved to hold off.

David Wick did not get his delivery last week but we will stay on them.

Nextera was supposed to begin tomorrow and the LDs started on the 14^th.

Commissioner Gulmon thanked the FD for saving the city that money.  Shout out to Carl for all the work he’s been doing on the ordinances.

Mayor Carlsrud thanked Forester Bob for all the work he does and the Image and Beautification committee for the work they do. Cost increases are crazy and we are not immune to inflation.  We try to minimize the increases and you can help to by recycling.

Approve Recommended Changes to the Stilling Well. 

City Administrator Crawford stated this is referring to the concrete fixture by the Little Dam.  With the corrections that have to be made it will no longer be needed.  Due to the age there has been talk about making some sort of commemorative plaque. The cost to maintain it for no use and the safety are high.

Commissioner Bishop moved to approve, seconded by Commissioner Erickson.  Motion passed unanimously.

Approve Final Review and Acceptance for 7th Ave. NW & 2^nd Ave NE Reconstruction Project (Paving 119/119B, Storm Sewer 52, Sanitary Sewer 64 and Water Main 100). 

Chad Petersen recommended approval to close out the projects.

City Administrator’s Report

City Administrator Crawford stated the Swankey addition is being finished today. There is a sprinkler that needs to be fixed by Riverview Drive and after that just some small odds and ends. Nextera has not gone well.  The substantial completion date is October 14^th so it will be an interesting week to see how it all gets done.City Updates & Commission Reports

Police Chief Hatcher encouraged everyone to come out to the football game and to vote Team Law for the blood drive.

Commissioner Gulmon reported on finances.

Commissioner Erickson reminded people the grass site is for branches and leaves only.  Due to several requests there will be a trial run of having the landfill open November 19^th and December 17 from 8-noon.  If it’s not cost effective, we will not continue.

Commissioner Magnuson encouraged everyone to get out and walk the community.

Mayor Carlsrud added that the not every community has the branch and grass site.  It’s free of charge and if you can’t “play by the rules” we will have to discontinue it.  Also, we are facing some cost increases.  The more recycling, we can do will help with that as there will be less to haul to Fargo.

City Attorney Martineck stated the purpose of this ordinance is to clarify where plantings and fences can be placed on a lot. The reference point for the corner triangle where you wouldn’t be able to plant or build a fence is 30 feet from the corner of the property line rather than 30 feet from the corner of the street.

City Attorney Martineck stated the one change since the first reading is in section 8-07-02 subsection c is recreational vehicles can be parked in private garages but only one outside of the private garage subject to the conditions in the section.

Al Schuldt commented as he allows his neighbor to park their RV in front of his house to avoid causing a bottle neck and requested a permit or some type of approval in certain circumstances.

Consider Purchasing a 2013 E-One Pumper Truck to replace the 1992 E-One Pumper Truck.

Fire Chief Magnuson stated this truck is on the list to be replaced. We were offered a grant for $80,000 to purchase a new truck but we declined as that amount on a new truck doesn’t really do much.  This truck became available due to them consolidating with another department so are getting rid of some.

Commissioner Gulmon motioned to approve the purchase up to $250,000, seconded by Commissioner Erickson.  Motion passed unanimously.

City Administrator Crawford requested City Attorney Martineck do an amendment on the agenda for the land purchase on NB2.

City Attorney Martineck stated we will need the land purchase as a Resolution.

Chad Petersen from KLJ reported that everything on the clay removal cleanup has pretty much been taken care of other than some properties with some damage. 6^th St NW is scheduled to be seeded this week. 8^thAve/12^th St is being wrapped up. Pavement marking is scheduled Thursday and Friday of this week. There is a Public Input meeting for the 2^nd Ave/3^rd Street Reconstruction project.

City Attorney Martineck stated the originally came before the PZ Commission as a variance when someone wanted to put a fence on a corner lot in a front yard.  The issue is the definition of what is considered a front yard on a corner lot.  PZ is recommending instead of having two front yards, you have a front lot line where your residential address is and you have secondary lot line where it is facing the street.  There would be restrictions on placement.

City Administrator Crawford stated this is to correct the issue by the Elks building.  This is so we will purchase the materials for warranty purposes and get reimbursed by KLJ.

City Administrator’s Report

City Administrator Crawford reported that our flood wall was hit last week. KLJ will have a structural engineer do an assessment and will determine at that time if anything further is needed.

Viking Court is supposed to have a resolution of how we are going to do the first stage by fall. Interstate Engineering is working on some design adjustments due to delivery and price concerns however they believe the complete storm drainage will be done this year.

City Updates & Commission Reports

Deputy Auditor Klein stated on September 14^th there will be a special assessment hearing for 7^th Ave N and 2^nd Ave NE and also Central Ave South that was in conjunction with Streetscape II.

Police Chief Hatcher stated there will be a parade on Thursday heading northbound for the Summer Vikes on Central and encouraged participation.

Chad Petersen from KLJ provided an update on construction projects. 12^th St N pavement marking is being wrapped up and one last driveway that is being worked on.  Petro south half is complete and will switched to the north half next week. Marking will be complete the end of September.  The clay removal is complete, top soil is complete and the seeding will be taken care of in the next few weeks. 6^th Street seeding will be taken care of soon; the contractor did spray for weeds so in the next week or so they will take care of the seeding.

Commissioner Gulmon reported the cashflows are strong and reserves are within policy. The city received the final disbursement of the American Rescue Plan funds which are limited to infrastructure projects.  Sales Tax revenue was down about 4.5% and the Food and Beverage Tax was up about 6%, the Hotel Occupancy Tax was up about 14% and the highway tax was up about 2%.

Commissioner Erickson reported that Dustin in Public Works received his CDL.

Mayor Carlsrud thanked Jennifer for all she does and the team that helped with the audit. Brenda and Brandy, thank you for stepping up in the succession plan.  School is back in session and traffic patterns change so please be careful and safe and encouraged attendance at Summer Nights on Central.

Consider 12^th St NW Expansion Proposal.

City Administrator Crawford stated there would be 10-12 lots and there is discussion for more growth. They are requesting we extend the roadway, watermain and sanitary sewer to this section. The area is in our utilities in electric but we have to check on water.

Commissioner Magnuson motioned to use Prairie Dog funds with the balance remaining coming from federal funds with a developer’s agreement between H&G Holdings and the City, seconded by Commissioner Bishop.  Motion passed unanimously.   

Public Hearing on Dangerous Building Located at 925 2^nd St SE.

President Carlsrud declared the public hearing open.

City Attorney Martineck stated Fire Chief Magnuson has been working with the owner of the property and there was an agreement to have it cleaned up and it is still not.  Pursuant to the code it comes before the commission.

Fire Chief Magnuson stated we have been watching this since spring has gotten here and nothing has been done. Neighbors are questioning why nothing is getting done.  We need to move forward and get it cleaned up and recommending no longer than 30 days to give them time to get it cleaned up.  If it’s not done at that time we go out for bids and assess the cost to the property.

Property owner Gary Staudacher stated he doesn’t have the funds or energy to clean it.  Requested the city take it but they want it cleaned up.

City Administrator Crawford asked City Attorney Martineck if they could give it to the city if there was an owner on there that had passed away?

City Attorney Martineck stated they would look into the process of the sale of the property since there is more than one owner.

City Administrator’s Report

City Administrator Crawford reported that the levees have started to be removed.  They are working to get the VCSU area cleaned up with college moving in this Friday. Everything should be done no later than September 21^st.  If you have any damage, let us know and that will be addressed in the next step.

City Updates & Commission Reports

PW Manager Jacobson reported the 3^rd year of the recycling contract just ended in July.  The contract called for a base limit of 900 tons and Valley Recycling hit 1,230 tons. A couple of months ago we received a letter from the City of Fargo and the rates for hauling our waste to them is going up $5 and they may be adding a surcharge for anybody out of the county. 

Chad Petersen from KLJ provided an update on construction projects. 6th St. is pretty much wrapped up, sod will take place when temperatures cool down. 12^th St N mill and overlay will begin tomorrow and paving is scheduled for Thursday.  Temporary striping will be in place prior to school starting.

Review Petition for Vacation of Four Bottle Drive and Approve for Further Consideration of Planning and Zoning Commissioner.

City Attorney Martineck stated there is currently a verbal agreement between the businesses on Four Bottle Drive and City Staff to vacate the length of that and turn if over to private ownership.  Details are being worked out but we wanted this approved so we can send it to PZ.

Commissioner Bishop moved to approve, seconded by Commissioner Erickson.  Motion passed unanimously.

Approve and Award Bid for Temporary Levee Removal.

Chad Petersen stated the bid opening was held on August 2^nd and 2 bids were received with the low bid coming in at $827,079.97 by Scherbenske out of Jamestown.  Strata had the other bid at $991,811.60. Recommendation is to award the contract to Scherbenske.  Once that is awarded the contractor has to start work within 14 days and the clay removal has to be completed within 3 weeks and 2 weeks after that the topsoil, seeding and restoration has to be complete.

Commissioner Bishop moved to approve, seconded by Commissioner Gulmon.  Motion passed unanimously.

Approve the City’s Selection to Purchase the DEF Tank Equipment from Dakota Plains Ag/CHS for the total of $1,872.24.

City Administrator Crawford stated this is in conjunction with another piece of the USDA grant but it took a while to get the bids in.

City Administrator’s Report

City Administrator Crawford reported after the work they did on Crestwood the supplies were $42,000 and the cost of the dig was $22,000 so we will work on getting that study done through our emergency manager.

City Updates & Commission Reports

City Assessor Hanson reported that next week is the State Equalization meeting in Bismarck and the annual conference and she and Tina will be attending.  There were no protests at the city or county meeting so we are expecting no issues.  Assessor Hansen stated that August 12^th will be her official last day before retirement.

Chad Petersen from KLJ provided an update on 6^th St. NW opened Thursday.  The seeding will take place when weather conditions are a little cooler. They did spray it with hydro mulch on there as an erosion measure.

12^th St NW they are working on ADA ramps.  The concrete, mill and overlay will be done before August 20^th. Once they are done with that concrete, they will move over to Petro to start on that portion of the project.

Commissioner Gulmon reported that the preliminary budget had been approved.  Thank you to all department heads and portfolio holders.  A lot of work has taken place to get to this point.  Special thanks to Avis, Brenda, Gwen and Mayor Carlsrud for sitting through all the workshop budget meetings that have taken place.

Commissioner Erickson reminded everyone to have their garbage out by 7:00 AM.  The Master Lift Station will be cleaned on the night of August 11 when water usage is already down but if possible, try to minimize usage beginning around 9:00 PM.

President Carlsrud mentioned that this has been the best budget process that he has experienced so than you to all that made that happen. Sunday the Fire Department had a day of activities for their families.  Thanks to the volunteers for all they do.  Thank you to Sandy for all of the years you’ve invested in the City of Valley City.
